Welcome to SriLankaVPS.lk. These Terms and Conditions govern your use of our VPS hosting services. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, purchasing services, or accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Service Description

SriLankaVPS.lk provides Virtual Private Server (VPS) hosting services, including but not limited to:

  • Virtual server instances with dedicated resources
  • Network connectivity and bandwidth
  • Storage space and backup services
  • Technical support and maintenance
  • Control panel access and management tools

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By registering, you represent and warrant that you meet these requirements.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Payment Terms

4.1 Pricing

All prices are listed in Sri Lankan Rupees (LKR) and are subject to change with 30 days' notice. Current pricing is available on our pricing page.

4.2 Billing Cycles

Services are billed on a monthly basis unless otherwise specified. Payment is due at the beginning of each billing cycle. Failure to pay may result in service suspension or termination.

4.3 Payment Methods

We accept the following payment methods:

  • Credit/Debit Cards (Visa, MasterCard, American Express)
  • Bank Transfers
  • Local Payment Gateways (FriMi, eZ Cash)

4.4 Refund Policy

We offer a 7-day money-back guarantee for new customers. Refund requests must be submitted within 7 days of initial purchase. Refunds are not available for renewals or upgrade charges.

5. Acceptable Use Policy

You agree not to use our services for:

  • Any illegal activities or purposes
  • Sending spam or unsolicited bulk emails
  • Hosting or distributing malware, viruses, or harmful code
  • Copyright infringement or intellectual property violations
  • Phishing, fraud, or deceptive practices
  • Resource abuse that affects other users
  • Adult content or illegal pornography
  • Cryptocurrency mining without prior approval
  • Network scanning or security breaching attempts

6. Service Level Agreement (SLA)

6.1 Uptime Guarantee

We guarantee 99.9% uptime for our VPS services. This excludes scheduled maintenance, which will be communicated in advance.

6.2 Maintenance

We reserve the right to perform scheduled maintenance with at least 48 hours' notice. Emergency maintenance may be performed without prior notice when necessary for security or stability.

6.3 Service Credits

If we fail to meet our uptime guarantee, you may be eligible for service credits as follows:

  • 99.0% - 99.9% uptime: 5% credit
  • 95.0% - 98.9% uptime: 10% credit
  • Below 95.0% uptime: 25% credit

7. Data and Backups

7.1 Your Responsibility

You are responsible for maintaining your own backups of all data stored on our servers. While we perform regular backups, these are for disaster recovery purposes only and may not be available upon request.

7.2 Data Security

We implement industry-standard security measures to protect your data. However, we cannot guarantee absolute security. You are responsible for implementing your own security measures.

7.3 Data Retention

Upon service termination, your data will be retained for 7 days, after which it will be permanently deleted. We are not responsible for data loss after this period.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on our website and platform belong to SriLankaVPS.lk or our licensors. You may not use, copy, or distribute any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, SriLankaVPS.lk shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Third-party actions or content

Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim.

10. Termination

10.1 By You

You may terminate your account at any time by contacting our support team. No refunds will be provided for partial months of service.

10.2 By Us

We reserve the right to suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or for non-payment. We will provide notice when possible.

11. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of significant changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.

13. Privacy Policy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

14. Support

Technical support is available 24/7 through our ticketing system and live chat. Response times may vary based on the severity of the issue and your service plan.

15. Indemnification

You agree to indemnify and hold harmless SriLankaVPS.lk, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these terms.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or infrastructure failures.

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SriLankaVPS.lk regarding the use of our services.
